THE REFUGEE PROTECTION DIVISION (RPD)

The Refugee Protection Division (RPD) is an extension/division of the Immigration and Refugee Board of Canada (IRB) that addresses claims for refugee protection made in Canada and make decision regarding their acceptance or denial.

Canada has the obligation to provide protection to Convention refugees and people in need of protection within several United nations convention where Canadian government is a signatory. Part of this includes Convention Relating to the Status of Refugees (1951), the Convention against Torture and Other Cruel, Inhuman and Degrading Treatment or Punishment (1984), and the International Covenant on Civil and Political Rights (1966)

Who is a Refugee Protection Claimant?

  • A refugee protection claimant whose eligibility has not yet been determined; or
  • A refugee protection claimant whose claim has been determined to be eligible; or
  • A refugee protection claimant whose claim has been decided by the Refugee Protection Division (RPD), but who has not exhausted all appeals of the decision;
 

 

Yet, this does not mean:

  • A refugee protection claimant whose claim has been determined to be ineligible; or
  • A refugee protection claimant whose claim has been rejected by the court of last resort.
